Since the Mental Capacity Act came into force , Lasting Powers of Attorney have been in existence There are two types of Lasting Powers of Attorney, the first for Property and Financial Affairs and one relating to Personal Welfare. These documents replaced the Enduring Power of Attorney.
As if to confirm their popularity, the Office of Public Guardian has just revealed that registration of Lasting Powers of Attorney has trebled in the last year to 210,000.
Traditionally Lasting Powers of Attorney have been perceived by the public as being the premise for the older client putting their affairs in order before they lose capacity. This however is all set to change as the Office of Public Guardian aims to ensure that eventually all UK citizens over the age of 18 make a Lasting Power of Attorney. This is indeed a drastic demographic change, but one which hopefully will be embraced by the next generation as essential and as a matter of fact. In particular consideration of the need for a Lasting Power of Attorney can be exceptionally important for certain members of the population such as those in the armed forces or other high risk employment, or those who indulge in sporting activities.
It is easy to contact and use your solicitor to advise and prepare Lasting Powers of Attorney and they usually cost in the region of £250 for each Lasting Power, with the ability to register the same at the Office for Public Guardian for a further £130.
