Divorce Proceedings
Our experienced divorce lawyers in South Wales are adept at managing the emotional and practical complexities of marital dissolution, whether in opposite-sex or same-sex marriages.
We understand the concerns regarding the complexity and cost of legal divorce proceedings. To address these, we offer clear, fixed-fee arrangements to manage expenses effectively. Our divorce lawyers provide tailored advice and practical support, leveraging experience in dispute resolution to ensure a smooth process.
Under the Marriage (Same-Sex Couples) Act 2013, same-sex marriages are treated the same as opposite-sex marriages in legal terms, requiring similar divorce procedures. Our divorce lawyers are proficient in handling divorces for all couples, offering sensitive and dedicated support.
Our team aims to deal with your divorce process with minimal disruption and court involvement, striving for amicable resolutions and approaching each case with compassion and pragmatism to obtain the best possible outcomes.
Financial Matters
Securing your financial future post-divorce or dissolution can be a challenging and difficult time. Our experienced family law specialists are committed to guiding you through this process with expert advice and robust representation.
Our divorce solicitors handle complex financial matters with precision, aiming for a fair settlement while minimising court involvement. As members of the Resolution Collaborative Law Scheme, we prioritise constructive and amicable resolutions through collaborative meetings with all parties and their solicitors.
We also recommend mediation as an effective alternative to litigation. This involves an impartial mediator to resolve financial issues, reducing the need for contested court hearings.
Should mediation and collaborative methods be impractical, our divorce solicitors are prepared to offer exceptional court representation, striving to achieve the best possible outcome for you.
Separation
Separation from an unmarried partner can present a unique set of challenges, particularly when it comes to dividing joint assets and property. The process of untangling shared financial interests and responsibilities requires careful handling to ensure that each party’s rights and contributions are fairly acknowledged.
The primary objective of our family law solicitors is to facilitate a smooth and amicable resolution to these matters. We aim to achieve this by providing guidance, negotiating a fair financial settlement and drafting a comprehensive ‘Separation Agreement’ tailored specifically to your situation. This agreement will address the division of assets, liabilities, and any other relevant financial matters, with the aim of reaching a mutually acceptable resolution that minimizes conflict.
Our constructive approach is to resolve these issues out of court whenever possible, employing negotiation and mediation techniques to achieve a fair and equitable agreement. Mediation provides an opportunity for both parties to discuss their concerns and reach a consensus with the assistance of an impartial mediator, often leading to a more satisfactory and less adversarial outcome.
However, we understand that in certain situations, reaching an agreement through negotiation or mediation may not be feasible. In such cases, where court proceedings become necessary, you can be assured of receiving exceptional representation from our team. We will advocate vigorously on your behalf, leveraging our extensive experience and legal expertise to navigate the complexities of court proceedings effectively. Our goal is to secure the most favorable outcome for you, ensuring that your interests are protected throughout the legal process.
Whether through amicable negotiation or through the court system, our team is committed to providing you with the highest level of support and representation, guiding you through each step of the separation process with professionalism and care.
Dissolution of Civil Partnerships
The dissolution of civil partnerships does not necessarily need to be a contentious or complicated process. Since December 5, 2005, same-sex couples have had the legal right to register as civil partners, and the procedure for ending a civil partnership is designed to be analogous to that of divorce, with similar legal principles and processes in place.
The primary ground for dissolving a civil partnership is that it has broken down irretrievably. Unlike divorce, where adultery can be cited as a reason for the breakdown of the marriage, civil partnership dissolution does not allow for adultery as a ground. Instead, the grounds available include ‘unreasonable behaviour’ or a separation period of at least two years. These grounds must be substantiated with evidence, and our team can assist you in presenting a compelling case.
In many instances, dissolutions can be managed without the need for court intervention. Through effective negotiation and mediation, it is often possible to reach an amicable resolution that addresses the interests of both parties involved. Our aim is to facilitate this process with minimal disruption, prioritizing a smooth and respectful resolution.
Our family law team at Martyn Prowel Gartsides is dedicated to managing your dissolution with efficiency and care. We understand the emotional and practical complexities involved, and we are here to guide you through each step of the process. For urgent assistance or to schedule a consultation, please contact us directly via phone or email. We are committed to responding promptly and providing the support you need during this time.
Children Matters
Our experienced team of family solicitors, including Children Panel members and collaborative lawyers, is adept at handling complex children’s law matters. Collaborative lawyers facilitate meetings where each parent, represented by their solicitors, works together to resolve issues without court intervention. Mediation is also encouraged and supported by the court, offering a way for parents to reach agreements with the help of an independent mediator, thereby avoiding contested legal proceedings.
If these methods do not resolve the issues, we will provide comprehensive representation in court. Our focus is always on the best interests of the child, and we are dedicated to guiding you through negotiations and court processes while minimising distress for both you and your child.
The Children and Families Act 2014 enables parents to obtain Child Arrangement Orders to formalise arrangements. In cases where parents cannot agree on matters such as a child’s surname, schooling, or more serious issues like abduction, our expert team is prepared to offer the highest level of legal support.
Please note that legal aid is now available only in exceptional circumstances. For more information, please contact one of our family solicitors today.
Prenuptial Agreements
In today’s legal landscape, drafting a settlement agreement prior to marriage or civil partnership has become increasingly prevalent, as courts now give considerable weight to such agreements. These prenuptial agreements serve as a proactive measure to address and manage potential financial issues that may arise in the event of a relationship breakdown, providing a structured and agreed-upon framework for the distribution of assets and liabilities.
If you are preparing to marry and wish to protect your premarital assets, or if you have been approached about entering into a prenuptial agreement, our experienced family law solicitors are well-positioned to assist you. We offer comprehensive support in the drafting and negotiation of prenuptial agreements, ensuring that your interests are effectively safeguarded.
A Prenuptial Agreement, commonly known as a “prenup,” is a legally binding contract established before marriage or civil partnership. This agreement specifies how property, debts, income, and other financial assets will be allocated should the marriage or partnership end in divorce or dissolution. By clearly delineating the terms of asset division, a prenuptial agreement aims to reduce potential conflicts and provide clarity and security for both parties involved.
Our team of skilled family lawyers will work closely with you to understand your specific needs and circumstances, crafting a prenuptial agreement that reflects your intentions and protects your interests. We guide you through the legal intricacies of the process, ensuring that the agreement is comprehensive, fair, and enforceable.
Cohabitation Agreements
Unmarried couples are increasingly advised to draft Cohabitation Agreements (or ‘No Nup’ Agreement) to outline the financial terms of their relationship and address asset division in the event of separation.
Our family lawyers can draft an agreement which is vital for protecting the interests of unmarried couples, who lack the financial protections afforded to married couples. A well-drafted Cohabitation Agreement should specify its duration and include provisions for regular reviews, such as every five years, to ensure its relevance and validity. While not providing the same legal status as marriage, such an agreement helps mitigate disputes over property and assets by serving as a formal, binding contract.
Additionally, unmarried couples should consider drafting a Will to clearly articulate their wishes in the event of death.
Domestic Abuse
If you or someone you know is experiencing domestic violence, our family lawyers are here to offer crucial assistance and support during this challenging time. At Martyn Prowel Gartsides, our family lawyers are equipped with the experience and expertise required to help you navigate through the complexities of this sensitive and distressing situation.
Domestic abuse is a serious issue that demands immediate and effective intervention. Our team is dedicated to providing a compassionate and supportive approach, ensuring that you receive the necessary protection and guidance. We understand the urgency and delicacy involved in such cases and are committed to helping you take the appropriate legal steps to safeguard your well-being and that of your family.
Our family lawyers will remain committed to providing you with a supportive and understanding environment. We recognise the emotional and psychological impact of domestic abuse, and our team is dedicated to offering not only legal assistance but also the reassurance and empathy required to help you move forward.
