Why is it so important? Both parties to a divorce should ideally ensure that not only do they get a decree absolute of divorce but that they also obtain one final order from the court which deals with the division of all the matrimonial assets. Before a final order can be made, the court will want to ensure that ‘fairness’ is achieved between the parties. The only way to ensure peace of mind that an order is ‘fair’ is to examine the entire financial circumstances of both parties to the marriage. This means ensuring that full disclosure is provided by each party, supported by documents such as wage slips, bank statements, valuations and pension details.
