Multi million pound Clinical Negligence claim

The Clinical Negligence Department has just finished a claim which resulted in the payment of a multi-million pound sum in agreed damages which have been approved by the Court. The client had a raised PSA test and opted for radical prostatectomy, which is the entire removal of his prostate, but unfortunately the operation was negligently performed in a Swansea Hospital and he had to have in rapid succession other operations to try to correct the damage done. This caused him to have a heart attack and serious stroke leaving him, after very lengthy attempted rehabilitation, in a wheelchair and unable to speak. We secured an early apology and full admission of liability from the Trust as well as substantial interim payments to pay for intensive private neuro-rehabilitation and the purchase of a suitable large bungalow in substantial grounds together with all adaptation costs and upkeep costs for life. We acted for the client under a Conditional Fee Agreement with associated insurance covering the risk of failing to beat formal offers in settlement and having to pay costs to the other side as well as the client’s disbursements in the claim such as substantial Court fees and medical expert fees. In this way we have helped to ensure that the client has the very best care and treatment available and enjoys life to the full insofar as he is able to with his disabilities. This includes care and assistance on a permanent basis including help taking the client on holidays abroad since he used to enjoy such regular holidays before the operation.
