We live in a time where life expectancy continues to increase. Research suggests that by 2030, the average life expectancy of a woman will be 85 years and for a man, 82 years. It is important that we all think and plan for our future, particularly when it comes to our health.
An Advance Decision, otherwise known as a “Living Will”, is a legal document which can stipulate what medical or healthcare treatment you want to refuse in the future. This could be for particular types of life prolonging treatment or resuscitation. It must be made by someone who is over the age of 18 and has the capacity to make such decisions for themselves.
It would then be used in the future if you became incapable of expressing your wishes to your family or healthcare professional. It can be used alongside a Lasting Power of Attorney (LPA) but an LPA could override the Living Will. It is important to seek legal advice to ensure you wishes would be followed.
It can be daunting to think about these issues. This is why it is important that these decisions are carefully thought through and are discussed with a legal professional. At Martyn Prowel Gartsides, we have the expertise to deal with Advance Decisions and our ultimate aim is to ensure we deliver a service that meets the needs of our clients in a professional and supportive way.
